Nightwatch is an experimental security operations system. The hosted service at nightwatch.run is a managed lab—not a production security service—and carries no service-level commitment.

Plain-language warning. Use Nightwatch at your own risk. Do not rely on it as your only security control, submit sensitive or production data to the hosted lab, or act on its output without qualified human review.

Terms of use

These Terms govern access to Nightwatch, including the hosted evaluation service at nightwatch.run (the “Hosted Lab”). Nightwatch is provided by Aaron Gerard Davidson, California, United States (“Provider”). By accessing or using Nightwatch, you agree to these Terms. If you use it for an organization, you represent that you are authorized to bind that organization.

You must be at least 18 years old and legally able to agree to these Terms. If you do not agree, do not use the service.

A managed lab, not your production SOC

The Hosted Lab is a test and evaluation environment. Data, detections, devices, identities, incidents, and responses displayed there may be synthetic, simulated, incomplete, delayed, changed, reset, or removed without notice. The environment may be shared or managed for demonstrations and testing.

  • Do not upload production telemetry, secrets, regulated data, personal data you lack authority to process, or information whose loss would cause harm.
  • Do not treat lab findings as proof that an event did or did not occur.
  • Maintain your own monitoring, response, backups, records, and security controls.

Authorized and responsible use

You may use Nightwatch only on systems, accounts, networks, and data you own or are expressly authorized to assess. You are responsible for applicable law, contracts, permissions, notices, and consents.

You may not use Nightwatch to gain unauthorized access; harm, disrupt, probe, or surveil third parties; evade safeguards; distribute malware; overload the service; extract credentials or other users’ data; or misrepresent generated output. We may suspend or terminate access when reasonably necessary to protect the service, users, or others.

AI and automated output

Nightwatch may use models and automated rules to summarize evidence, propose explanations, rank attention, or suggest actions. Outputs can be inaccurate, incomplete, biased, stale, or fabricated. They are not professional, legal, compliance, or incident-response advice.

You are responsible for reviewing evidence and consequences before acting. Do not automate consequential changes solely from model output. Third-party model and infrastructure providers may process data under their own terms and privacy practices.

Free evaluation; no support commitment

Nightwatch is currently offered free of charge for evaluation. There is no uptime, response-time, support, preservation, compatibility, security, recovery, or feature commitment. We may change, suspend, restrict, or discontinue any part of it at any time. Preview features may never ship.

No warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHTWATCH, THE HOSTED LAB, DOCUMENTATION, OUTPUTS, AND ALL RELATED MATERIALS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” PROVIDER DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, AVAILABILITY, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

No statement or demonstration creates a warranty. Some jurisdictions do not allow certain exclusions, so some of these exclusions may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS; SECURITY INCIDENTS; SERVICE INTERRUPTION; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO NIGHTWATCH, EVEN IF ADVISED THAT SUCH LOSS IS POSSIBLE.

PROVIDER’S AGGREGATE LIABILITY ARISING FROM OR RELATED TO NIGHTWATCH WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PROVIDER FOR NIGHTWATCH DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

These limits apply regardless of the theory of liability and do not exclude liability that cannot lawfully be excluded. You agree to defend and indemnify Provider from third-party claims resulting from your unlawful use, your data, or your violation of these Terms, to the extent permitted by law.

Self-hosted deployments

Access to the Hosted Lab does not grant a license to copy, distribute, or deploy Nightwatch. Any self-hosted copy is governed by the license or written terms delivered with that copy. Operators of self-hosted deployments—not Provider—control their environments and are responsible for installation, access, security, data handling, model providers, backups, compliance, notices, and support.

Nightwatch may include third-party components governed by their own licenses. Product names and trademarks remain the property of their owners.

Hosted Lab privacy notice

For the Hosted Lab, we may process account identifiers, email addresses, authentication and security logs, IP and browser information, configuration choices, feedback, lab activity, and diagnostic telemetry. We use this information to provide and secure access, operate and improve Nightwatch, communicate about accounts, investigate abuse, and meet legal obligations.

We may use infrastructure, email, analytics, and AI/model service providers to perform those functions. Information sent to a model provider may be processed outside Nightwatch. Avoid submitting personal or confidential information in prompts, feedback, configuration, or evidence.

We retain information only as long as reasonably needed for these purposes, security, backups, dispute resolution, or law. Lab content may be routinely reset. We do not promise archival storage. We may disclose information when required by law, to protect rights and safety, in a business transfer, or to service providers acting for us.

Nightwatch uses technically necessary cookies or similar storage for authentication, security, and preferences. We do not state that we sell personal information or use cross-context behavioral advertising. If that practice changes, this notice must be updated before the change.

California law, changes & contact

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. These Terms and any applicable written license are the complete agreement about their subject matter.

Privacy rights vary by location. To request access, correction, or deletion, or to raise a legal or privacy concern, email [email protected]. We may need to verify your identity and may retain information where legally permitted or required.

We may revise these Terms and this notice. A new effective date will identify material revisions. Continued use after revised terms take effect constitutes acceptance where permitted by law.
